Terms of Service (EULA)

1. Agreement to these Terms

These Terms of Service ("Terms") apply when you download, install, open or play ChessElementa (元灵象棋, "the Game"). This includes the website at https://chess.rwen.me and the apps on Google Play, TapTap and the Apple App Store. By using the Game you agree to these Terms. If you do not agree, do not use the Game.

Our Privacy Policy explains how we handle information and forms part of these Terms.

2. License

Lantao Studio (蓝桃游戏, "Developer", "we" or "us") grants you a limited, revocable, non-exclusive, non-transferable license to download, install and use the Game for your personal, non-commercial entertainment, strictly in accordance with these Terms.

3. Intellectual property

The Developer owns the Game, including its code, graphics, artwork, sound, music, puzzles and gameplay mechanics. Copyright and other intellectual property laws protect it.

Third-party materials

The Game includes the following third-party materials, used under their licenses:

• GSAP (GreenSock Animation Platform): GreenSock Standard License.
• Howler.js: Copyright (c) 2013–2023 James Simpson and GoldFire Studios, Inc., MIT License.
• Fonts: Ma Shan Zheng (Copyright (c) 2018–2019, Ma Shan Zheng), LXGW WenKai (Copyright (c) 2021, LXGW) and Noto Sans SC (Copyright 2014–2021 Adobe), all under the SIL Open Font License 1.1.
• Game icons (SVG) by sbed, Lorc and Delapouite from game-icons.net, under CC BY 3.0.
• Sound effects from freesound.org, CC0 (public domain).

4. Community Levels (user-generated content)

The Game lets you create puzzle levels and, if you choose, upload them to the public Community Levels section. There, other players can play, rate and report them. Everything you upload, including the level, its name, its description and the author name you enter, is "User Content".

4.1 Prohibited content

You must not upload User Content, including level names, descriptions and author names, that:

• contains hate speech, or attacks or demeans people based on race, ethnicity, nationality, religion, gender, sexual orientation, disability or any other protected characteristic;
• harasses, bullies, threatens or intimidates anyone;
• is sexual, pornographic or sexually suggestive;
• depicts, promotes or glorifies violence, self-harm or cruelty;
• is illegal, promotes illegal activity, or infringes anyone's intellectual property, privacy or other rights;
• is spam, advertising, a scam, or repeated or meaningless uploads;
• impersonates another person, organisation or the Developer;
• contains personal information of yourself or others, such as real names, phone numbers, addresses, email addresses or social media accounts;
• contains malicious code or tries to interfere with the Game or its servers.

4.2 How we enforce these rules

• Automatic filtering: uploads are automatically checked for objectionable words before they are accepted, and uploads that fail the check are rejected. Upload limits apply.
• Reporting: every community level has a small ⚑ (report) button, which lets you report the level and choose a reason. A level that receives several reports may be hidden automatically until we review it.
• Blocking: the same dialog lets you block the author (屏蔽作者), Blocking immediately hides all levels by that author on your device.
• Review within 24 hours: we review reports within 24 hours. We remove content that breaks these Terms and ban the users who posted it from uploading. You can also report content or users by email at lantao.studio@gmail.com.
• We may also review, remove or hide any User Content at any time, with or without notice, if we believe it breaks these Terms or harms the community.

4.3 Your responsibility

You are solely responsible for your User Content. You confirm that you have the right to upload it and that it complies with these Terms.

4.4 Ownership and license

You keep any intellectual property rights you hold in your User Content. By uploading it, you grant the Developer a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform and publicly display it in connection with the Game and the Developer's business, including for marketing and promotion.

If you delete your User Content with the in-game delete feature, our right to show that content to other players ends within a commercially reasonable time. This does not apply to backup copies, or to promotional materials made before you deleted it.

5. Prohibited conduct

You agree not to:

• harass, abuse or harm another person or group through the Game, including through level names, descriptions or author names;
• abuse the report or rating features, for example with false or mass reports, or ratings designed to manipulate rankings;
• attack, overload, scrape or try to gain unauthorised access to the Game's servers, or get around upload limits or bans;
• reverse engineer, decompile or disassemble the Game, except where the law permits it;
• use cheats, hacks or unauthorised software to modify or interfere with the Game;
• use the Game for any commercial purpose without our prior written consent.

6. Termination

If you break these Terms, we may suspend or end your access to Community Levels or to the Game, and remove your User Content, without notice. You may stop using the Game at any time.

7. Disclaimer of warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT USER CONTENT IS ACCURATE OR APPROPRIATE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE GAME, OR FROM ANY USER CONTENT.

9. App stores

If you got the Game from an app store, that store's own terms also apply. If you downloaded the Game from the Apple App Store:

• These Terms are between you and the Developer only, not Apple. The Developer, not Apple, is solely responsible for the Game and its content.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the Game.
• Apple is not responsible for any claims by you or a third party relating to the Game, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, consumer protection or privacy claims, or intellectual property infringement claims.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law principles.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. If you keep using the Game after a change, you accept the updated Terms.
